Abstract:
Taking the scientific view of practice as his theoretic base, for the first time, Marx solved the issue of the relations between subjectivity and objectivity in the philosophy development history of human being. Practice has the nature of both subjectivity and objectivity and the process of practice is a process of the gradual unification of subjectivity and objectivity. Practice is based on recognition and the subjectivity and objectivity recognition is also dialectical. Better recognition of the objective world and the reform of the objective world and better recognition of the subjective world and the reform of the subjective world require the understanding of subjectivity and objectivity in the dialectical unification relations and the using of the subjective and objective principles in the dialectical unification relations.Keywords:

Starting from emphasizing the objectivity or pursuing the ideal state of scientific knowledge,the rationalism leads itself to absolutism and thinks that scientific knowledge is absolutely objective.While starting from expressing the subjectivity or pursuing the actual state of scientific knowledge,the social constructivism leads itself to relativism and thinks that scientific knowledge is absolutely subjective.In fact,scientific knowledge is neither absolutely objective nor absolutely subjective,but a unity of objectivity and subjectivity based on practice.

Objectivity has been the aim of the criminal law interpretation, however, philosophical hermeneutic gives the traditional (objectivity). This paper tries to pursue the objectivity in the background of philosophical hermeneutic, arguing that the objectivity of (criminal) law interpretation lies in the conversation and inter-restriction between the prejudice of interpreter and kinds of objective (elements), thus objectivity is not the absolute objectivity in natural science sense, it is the rationality in Posner′s so-called (intercommunion) sense.
