Through this work it is intended to highlight the effects that can really be attributed to notarial
action, within the framework of the requirement of transparency in contracting. Through the analysis of
the jurisprudence and of the recent previsions accepted by Law 5/2019, of March 15, regulator of real
estate credit agreements, it will be specified how in no way the work of the notary can exclude or replace
the obligation of lenders to provide the borrower, with due notice to the effective contractual
relationship, sufficient and clear information about the content of the loan contract that allows the
potential borrower to compare between the existing offers in the market and really understand the
burden he will assume with the signing of a specific loan.
