Analysis of the Use of Genetic Testing in Insurance Policy Contracts and Labour Relations in Brazil

In view of the conceivable effects of genetic testing on insurance policy and labour contracts, and the consequential bioethical issues involved, the present article analyses the possibility of using these resources for risk selection in insurance policy contracts and as criteria for employability, in light of the current legal framework in Brazil. In that sense, we will address the question of whether genetic testing and profiling, which intrude much more on an individual’s intimacy and privacy than conventional medical examinations, may be considered as legal means of establishing selection criteria for a job position or used to assess risks in an insurance policy contract.
