La eficacia de las medidas de protección de los derechos fundamentales de la victima por violencia familiar.

ABSTRAC T The 0bjetive of the present investigation was to determine how protection measures would be mo re effective to protec t the fundamental rights of the victim of family violence in the Judicial District of La Libertad, 2016 2018 period. For the verification of the hypothesis, a sample c onsisting of 05 Cassations of the Supreme Court on family violence processes, 2016 2018, was considered; as well as the statistical report on family violence 2016 2018 ; 02 National Plenaries 2016 2017; and by 100 lawyers speciali zing in Family Law of Trujillo. To obtain the information, the techniques of observation, documentary analysis and the survey were used, with their respective data collection instruments. This information was organized and presented in frequency tables. Likewi se, the inductive deductive, analysis synthesis, hermeneutic and exegetic al methods were used to discuss the information obtained from the elements of the sample. The results allowed to conclude, verifying the hypothesis, that the protection measures would be more effective to protect the fundamental rights of the victim of family violence, if they were included among them, 1) The mandatory preventive psychological examination of couple, to detect early problems relatives and for the respective psychologica l treatment, because this is how future acts of family violence are prevented ; 2) The issuance of protection measures without the need for an oral hearing, and 3) The creation of a specialized police to guarantee the safety of the victims and the effective compliance with protecti ve measures.
