Propiedad de la tierra y socioeconomía de Cotorra en la Ciénaga Grande del Bajo Sinú

The purpose of this article is to analyze the socioeconomic and land situation from a legal approach to property in the San Pablo property located on the fringe of the Cienaga Grande del Bajo Sinu in the municipality of Cotorra, in order to facilitate the formalization of property for vulnerable peasants. Therefore, ideas are proposed on how to address conflicts related to the formalization of vacant lands derived from State administrative shortcomings, incorporating in this field of study the idea of space as a category of analysis that produces legally valuable contents. In this sense, problematizing property law conflicts from a spatial perspective can lead us to unveil new alternatives to understand and contribute to  the solution of this type of conflicts. The methodological approach is the case study, with specific results for the San Pablo property because it represents the largest of the 38,543 hectares with 2,000 m2 that make up the Cienaga Grande. Since this is an unpublished topic, lacking empirical evidence in the department of Cordoba, it was contrasted with the jurisprudential advances. The findings indicate that property is in itself, a right on which strong burdens converge, regardless of the holder of the right; thus, the economic, social and ecological function is intrinsically linked to property and therefore the holder must assume these burdens. Unlike when the holder is the State, because objectively it must deploy the traditional contents of jus utendi, jus fruendi, jus abutendi.
