Was könnte eine Entsiegelungsverordnung nach dem Bodenschutzgesetz bringen

Building, development and compression of soil leads to an increasing sealing. This is responsible for the extensive reductions of natural functions of soil. 5 Bundes-Bodenschutzgesetz (BBodSchG) empowers to enact an ordinance on unsealing which makes it a duty to unseal under certain circumstances. But for these laws 5 BBodSchG defines only a relatively restricted area of application. Furthermore the proper authority which has to initiate an intended unsealing will face legal uncertainty as well as practical problems while examining the facts and determining the adequate duties. An ordinance on unsealing will be able to improve some of these arising difficulties. But its real value are the administrative rules which complement the already existing means. Moreover it is to expect that the technical requirements provided by the ordinance in respect of restoring the natural soil functions after unsealing will have influence on other fields (for example Nature conservation laws).
