Comparative Analysis on Public Interest of Property Expropriation System between China's and the U.S.——Comment on"The Expropriation of the Housing on State-owned Land and Compensation Ordinance(Draft)"

The property expropriation issue,such as,land expropriation and relocation,is one of the most prominent social problems in our nation.According to China's law,the expropriation activity is designed to meet the needs of the public interest,and then how to define the public interest becomes the key of the issue.In practice,due to the vague provisions of the public interest in the law and regulation,the public interest has not played a limited role to the expropriation,however,it has been misinterpreted the legal basis of discretion and becomes the protective umbrella of abuse of authority.Compared to China's,the U.S.'standards and procedures for definition what is the public use of property expropriation system has been relatively mature,and these are worthy of our reference.
