METODOLOGI FATWA MAZHAB IMAM AL-SHAFI'IYY: KAJIAN TERHADAP PENDEKATAN USUL MAZHAB DALAM PENGELUARAN HUKUM

Abstrak Objektif artikel ini mengkaji ketokohan imam al-Shafi c iyy dan sumbangan serta metodologi beliau dalam bidang pengeluaran hukum dengan melihat gambaran umum fiqh imam al-Shafi c iyy, dan manhajnya dalam pengeluaran fatwa. Metodologi diskriktif telah digunapakai pada kajian teks yang melibatkan sumber kontemporari dan tradisi. Artikel ini menekuni disiplin asas pegangan al-imam dan garis panduan yang telah dibuat bagi tujuan pengeluaran hukum. Hasil kajian mendapati bahawa mazhab imam al-Shafi c iyy ini muncul di tengah-tengah padangan perbezaan aliran mazhab iaitu antara dua disiplin ilmu yang ulung ketika itu iaitu disiplin Hijazziyyin dan c Iraqiyyin. Imam al-Shafi c iyy telah mendalami kedua-dua displin ini dan mengambil pendekatan yang jelas dan pertengahan atas perjalanan antara dua disiplin tersebut .    Kata kunci: al-Shafi c iyy, usul mazhab, fatwa, garis panduan, Hijaziyyin, c Iraqiyyin. Abstract The objective of this article is to discuss the stature of imam al-Shafi c iyy and his methodological contributions in the field of fatwa and Islamic jurisprudence. It examines the general overview of al-Shafi c iyy in fiqh diciplines, and his methodology in the production of fatwa. With the approach of descriptive methodology in textual analysis that involves contemporary and traditional sources, this article examines the dalil ijmaliyy (general rules and evidences) being used by al-Shafi c iyy and the guidelines that have been made for the purpose of issuing the hukm and fatwa. The finding of this research shows that al-Shafi c iyy’s dicipline emerged in the middle of great difference schools in Islamic Jurisprudence, Hijazziyyin and c Iraqiyyin and imam al-Shafi c iyy was steeped in both of this disciplines and adopt a clear and middle methodology in his school.  Keywords: al-Shafi ci yy, fiqh diciplines, guidelines, Hijazziyyin, c Iraqiyyin.
