Penerapan Restorative Justice Terhadap Tindak Pidana Yang Dilakukan Oleh Anak Di Kejaksaan Tinggi Gorontalo

Tujuan penelitian menganalisis implementasi Restorative justice dalam penyelesaian tindak pidana penganiayaan yang dilakukan oleh anak di Kejaksaan Tinggi Gorontalo dan Faktor- faktor yang mempengaruhi Jaksa pada Kejaksaan Tinggi Gorontalo untuk melakukan upaya Restorative Justice terhadap penyelesaian perkara Pidana yang dilakukan oleh anak Penelitian ini menggunakan tipe penelitian yaitu perpaduan antara penelitian hukum normatif dan penelitian hukum sosiologis, Dari hasil penelitian ditemui bahwa penerapan Restorative Justice telah diterapkan melaui Diversi berdasarkan pendekatan Keadilan Restoratif. Dalam penyelesaian kasus perkara anak tidak semuanya bisa diselesaikan dengan Restorative Justice. kurang efektif pelaksanaannya sesuai dengan ketentuan undang-undang yang berlaku oleh karna dipengaruhi oleh Faktor Subtansi hukum (legal substance), Faktor Struktur (legal structure), Budaya hukum (Legal culture). The research objective is to analyze the implementation of Restorative justice in the settlement of criminal acts of abuse committed by children at the Gorontalo High Court and the factors that influence the Prosecutors at the Gorontalo High Court to make Restorative Justice efforts to resolve criminal cases committed by children. Between normative legal research and sociological legal research, it was found that the application of Restorative Justice has been applied through Diversion based on the Restorative Justice approach. In solving child cases, not everything can be resolved with Restorative Justice. the implementation is less effective in accordance with the provisions of the applicable laws because it is influenced by the legal substance factor, legal structure factor, legal culture.
