El agente encubierto en la ley de drogas. La lucha contra la droga en la sociedad del riesgo (The Undercover Agent in the Drug Law. The Fight Against Drugs in the Risk Society)

Spanish Abstract: El presente articulo constituye un primer estudio en relacion a la figura del “agente encubierto,” de larga data en legislaciones comparadas e incorporada al ordenamiento juridico chileno, en el articulo 25 de la ley numero 20.000, nueva ley de drogas. De esta manera, luego de definir la citada figura, se realiza una aproximacion a las criticas que, en distintos escenarios, se han formulado al empleo de esta tecnica por parte del Estado en el ambito de la persecucion penal publica, intentando cuando menos enunciar los reparos constitucionales, tales como la eventual vulneracion al “derecho a la intimidad” o el “derecho a la inviolabilidad del hogar,” cuanto legales, por ejemplo que ocurre con la necesidad de autorizacion judicial previa en este caso, que merece la figura consagrada en la legislacion chilena.English Abstract: The following article represents a first time study of ”concealed police agents,” long contemplated in foreign legislations, but just recently incorporated to Chile’s positive law, in article 25 of the new law on drugs, law number 20,000. After defining the aforementioned institution, the article addresses the different criticisms formulated, in various scenarios, against the use of the “concealed police agents” technique by the State, in criminal prosecution, intending to at least enunciate the main constitutional and legal objections around this kind of agent in Chilean legislation, such as a possible violation of constitutional rights, e.g. the right to privacy and the right to home inviolability, as well as the eventual avoidance of previous judicial authorization as required by the legislation in those cases.
