On Concurrence of State Compensation and Civil Liability for Tort

When state compensation and civil liability for tort occurs concurrently, the private party can exercise his right of claim freely. However, when the liability is based on exercise of powers in violation of law, the private party's right of claim should be limited in two aspects: one is the right of claim itself, the other is the exercise of the right of claim.
