Fundamentos Ao Reconhecimento Do Dano Existencial Nos Casos De Superendividamento: Considerações Sobre O Mínimo Existencial,O Valor Do Tempo E A Concepção Normativa De Dano

The article analyzes the negative im­ pacts caused by insolvency in the daily life of the person and the family,especially under the focus of over-indebtedness,leading to social exclusion, whichjustifies the needto broaden the perception to new damages in a society marked by compulsi­ ve consumption. ln this sense, the analysis of the existential damage suffered by the consumer re­ veals the insufficiency of the "umbrella" concept of moral damage to repair the various forms of violation of human dignity caused by over-inde­ btedness and the theoretical attachment to the naturalistic conception of harm, insufficient to protect the dimensions of human existence inthe context of the postmodern society.The deductive method willbe used intheanalysis ofconstitutio­ nal principies, ordinary legislation and doctrine, in an attempt to form ulatea response based onvalid normative  parameters.
