PRAKTIK PEMBAGIAN WARISAN DI DESA ARA, KECAMATAN BONTOBAHARI KABUPATEN BULUKUMBA PERSPEKTIF HUKUM ISLAM

Abstrak Masalah pokok dalam penelitian ini adalah Bagaimana praktik pembagian warisan masyarakat Ara, Kecamatan Bontobahari Kabupaten Bulukumba perspektif hukum Islam. Adapun permasalahan dalam skripsi ini, sebagai berikut: 1) Bagaimana praktik pembagian warisan di kalangan masyarakat Ara Kecamatan Bontobahari Kabupaten Bulukumba. 2) Bagaimana Perspektif hukum Islam terhadap praktik pembagian warisan masyarakat Ara Kecamatan Bontobahari Kabupaten Bulukumba. Hasil penelitian tersebut menunjukkan bahwa Pembagian warisan menurut adat di desa Ara dikenal dengan adat butta atau biasa juga di sebut adat to riolo yang mana pembagian warisan di desa Ara mengharuskan bahwa anak laki-laki dari pewaris mendapatkan tanah dan tidak berhak atas rumah sedangkan anak perempuan tertua pewaris mutlak mendapatkan warisan berubah rumah dan anak perempuan pewaris tidak berhak atas warisan tanah tersebut. Dalam hukum Islam pembagian warisan di desa Ara sesunggunya dibolehkan karena sejalan dengan ajaran hukum Islam yang melarang adanya permusuhan. Sistem pembagian warisan masyarakat Ara Kecamatan Bontobahari sebenarnya telah tertuang pada Komplikasi Hukum Islam (KHI) pada pasal 183 yaitu pembagian warisan bisa dilakukan dengan cara sistem kekeluargaan atau damai. Adapun sistem kekeluargaan atau perdamaian dalam hukum Islam disebut dengan istilah takharuj. Kata Kunci: Hukum Adat, Hukum Islam, Warisan Abstract The main problem in this study is how the practice of dividing the inheritance of the Ara community, Bontobahari District, Bulukumba Regency, has an Islamic legal perspective. The problems in this thesis are as follows: 1) How is the practice of inheritance distribution among the Ara community, Bontobahari District, Bulukumba Regency. 2) What is the perspective of Islamic law on the practice of sharing the inheritance of the Ara community, Bontobahari District, Bulukumba Regency. The results of this study indicate that the division of inheritance according to adat in Ara village is known as adat butta or commonly also called adat to riolo where the distribution of inheritance in Ara village requires that the son of the heir gets land and is not entitled to a house while the eldest daughter the absolute heir gets an inheritance changing the house and the heir's daughter is not entitled to the inheritance of the land . In Islamic law the distribution of inheritance in the village of Ara is actually allowed because it is in line with the teachings of Islamic law which prohibits hostility. The inheritance distribution system for the Ara community in Bontobahari District has actually been stated in the Complications of Islamic Law (KHI) in article 183, namely the distribution of inheritance can be done by means of a family or peaceful system.
