LINGUAGEM E DIREITO: DIMENSÃO ENUNCIATIVA E ARGUMENTATIVA NA SEÇÃO DA FUNDAMENTAÇÃO DA SENTENÇA CONDENATÓRIA DE CRIME HEDIONDO

This work is based on the Language and Law interface. It follows the theoretical perspective of Textual Analysis of Discourses (ADAM, 2011) and its relations with Enunciative Linguistics (RABATEL, 2016). For that, it analyzes the enunciative responsibility in the section Rationale of the textual plan of the legal sentence condemnatory sentence, focusing on the points of view taken by the first enunciator speaker, in this case the judge, regarding the management of the sayings attributed to the second enunciators. The results of this study raise the linguistic-textual strategies in favor of the argumentative orientation, based on point of view management.
