Arbitragem em contratos de infraestrutura celebrados com a Administração Pública: desenvolvimento e energia

This article discusses the use of arbitration in public contracts, especially in infrastructure and energy sectors. In order to do so, based on a bibliographical review, it is focuses on the evolution of the arbitration institute in Brazil, recognizing important changes in the legislative and jurisprudential perspective, due to the resurgence of the institute with the advent of Law 13,129 / 2015, which gave permission about the possibility of its application to contracts involving the Public Power. In the end, the advantages in the use of arbitration are verified, especially with regard to celerity and specialization aspects, in addition to the lower transaction costs, with some aspects being discussed with regard to public law. It hopes to associate the institute in a context of an urgent resumption of development in Brazil.
