Políticas de educação no Brasil: desafios à regulamentação das leis e ao amplo acesso à educação pública

Resumo Este trabalho objetiva averiguar a tardia regulamentacao da Lei de Diretrizes e Bases da Educacao Brasileira – LDB (Lei 9.394/96), por meio do estudo do percurso historico da educacao e dos caminhos de sua consolidacao por intermedio da legislacao. O foco da investigacao esta, portanto, no estudo do percurso e contexto educacional do pais, vislumbrando elucidar os meios pelos quais perpassou o sistema educativo para que viabilizasse o amplo acesso a educacao publica. A metodologia de estudo e de carater bibliografico-documental, abordando perspectivas historicas educacionais, o percurso das Constituicoes brasileiras para que o campo da educacao fosse reconhecido, destacando as politicas publicas educacionais como meio para a efetivacao dos anseios sociais. Propoe-se uma analise critico-reflexiva acerca da tardia regulamentacao legal da LDB, e de que forma, a partir desta Lei, estabelece-se o conceito de igualdade entre cidadaos pertencentes a classes sociais distintas em relacao ao amplo acesso a educacao publica. Education policies in Brazil: challenges to regulation of laws and wide access to public education Abstract This work aims to verify the late regulation of the Law of Guidelines and Bases of Brazilian Education – LDB (Law 9.394/96), through a study of the history of education and the ways of its consolidation through legislation. The focus of the research is, therefore, on the study of the course and educational context of the country, seeking to elucidate the means by which it has crossed the educational system to enable broad access to public education. The study methodology is a bibliographical-documentary, approaching historical educational perspectives, the course of the Brazilian Constitutions so that the field of education is recognized, highlighting educational public policies as a means for the realization of social desires. It is proposed a critical-reflexive analysis about the late legal regulation of LDB, and how, from this Law, the concept of equality is established between citizens belonging to different social classes in relation to the broad access to public education.
