O ambiente da nova contratualidade e a tendência da jurisprudência do STJ em matéria contratual

This article aims to study the consolidation scenario in which contracts are entered from the globalization and its influence, and the dignity of the human person, as a counterpoint to globalizing pressure. In this sense, it is a visit to constitutional and civil doctrine, in the end, bring analyzes of legislative and jurisprudential evolution of the Superior Court in that "contractual environment". Thus, some recent sentences is analyzed from the Supreme Court that carry, in essence, the influence of the elements initially cited, taking into account precedents involving civil, business and consumer contracts.
