论“模仿讽刺”作品的法律性质及合理使用原则

The present law does not make definite provisions for parody. As a form of creative work, parody should be provided in copyright law and protected by fair use doctrine if it has originality and reproducibility. In order to solve the new problem preferably, this paper discusses how to alter and perfect the provisions on woks and fair use doctrine in ”Copyright Law of the People's Republic of China”, and step for balance between benefiting subjects.
