Hermenêutica das Escolhas e a Função Legislativa do Judiciário (Choice Hermeneutics and the Judiciary Law-Making Function)

Portuguese Abstract: Este artigo apresenta e explora a funcao legiferante dos magistrados no exercicio regular da atividade adjudicatoria que extrapola a atividade integrativa e o controle de constitucionalidade e que parece estar oculta dos juristas, em geral, em funcao do discurso dominante de que o magistrado apenas decide conforme o ordenamento juridico. Essa funcao legislativa ou a hermeneutica das escolhas sera demonstrada como sendo um elemento necessario de qualquer sistema juridico que veda o non liquet. English Abstract: This paper presents and explores the law-making function of judges in their regular adjudication activities that goes beyond the mere integrative exercise and constitution-ality control. This law-making function may be hidden from jurists in general by the dominant discourse that judges decide according to the law. This law-making function or choice hermeneutics will be shown to be a necessary element of any legal system that forbids the non liquet.
