PERTANGGUNG JAWABAN PIDANA TERHADAP PEMBUNUHAN YANG DILAKUKAN DIBAWAH PENGARUH MINUMAN KERAS

It is known that 28-year-old MT had committed a murder under the influence of alcohol against the perpetual victim of a member of the Provincial Military Command Headquarters 1701 Jayapura. Objectives (1) To find out the application of criminal responsibility to the perpetrators of murder committed as a result of the influence of alcohol at the Jayapura High Court No. 100 / Pid / 2016 / PT.JAP. (2) To find out the Judge's consideration in imposing a crime on the perpetrator of murder against the murderer which was carried out due to the influence of alcohol in the case No.100 / Pid / 2016 / PT.JAP. Research using a normative juridical approach using secondary data collected by document study, the data obtained were analyzed qualitatively. Research Results (1) Defendant MT was legally and convincingly proven guilty of violating Article 339 of the Criminal Code, the defendant was sentenced to 18 (eighteen) years in prison.
