Einverständniserklärungen für eine feministische Forschungspraxis. Überlegungen zur prozesshaften Gestaltung und gesellschaftlichen Einbettung von Einwilligung

Leseprobe ----- Zusammenfassung In diesem Beitrag wird der Frage nachgegangen, wie ein feministisches und postkoloniales Verstandnis von informierten Einverstandnisprozessen aussehen kann und welche konkreten Schlussfolgerungen fur die Forschungspraxis daraus resultieren konnen. Dabei wird zunachst der historische Entstehungskontext in der medizinischen Forschung beleuchtet und die daraus hervorgehenden Dimensionen – Kompetenz, Verstandnis, Information, Freiwilligkeit und Autorisierung – erlautert. Ausgehend von Perspektiven der feministischen Sozialforschung und der feministischen Ethik wird aufgezeigt, dass informiertes Einverstandnis uber den rechtlich-formalen Akt hinausgehen und als kollaborative und prozessorientierte Aushandlung zwischen Forscher_innen und Forschungsteilnehmer_innen konzipiert werden sollte. Es ist wichtig, soziale und gesellschaftliche Zusammenhange in Einverstandnisprozesse einzubeziehen, d.h. Subjekte im Sinne der intersektionalen Ethics of Care als relational zu begreifen und den Einfluss von sozialen Strukturen zu reflektieren. Auf Basis einer feministisch-postkolonialen Ethik wird hervorgehoben, dass es notwendig ist, bestehende Ungleichheiten anzuerkennen, um diese nicht zu reproduzieren. Flexible und wiederholbare Formate der Einverstandniserklarung oder das Etablieren von gemeinsamen Diskussionen sowohl in den Einverstandnisprozessen als auch in der Ergebnisdarstellung sind Beispiele fur mogliche Umsetzungen in der Forschungspraxis. Considerations about Processes and Societal Context of Giving Consent Abstract In this paper we develop a feminist and post-colonial understanding of informed consent and its consequences for a feminist research practice. We begin with describing the historical origins of informed consent in medical research with its main dimensions: competence, understanding, information, voluntariness and authorization. Based on perspectives of feminist social research and feminist ethics we elaborate that informed consent should move beyond the legally formalized procedure. Rather it should be conceptualized as collaborative, process-oriented negotiation between researchers and research participants. Furthermore, it is important to include social and societal contexts. In accordance with intersectional ethics of care we suggest understanding subjects as relational and reflecting on the effects of social structures. Based on feminist post-colonial ethics we stress that it is necessary to acknowledge existing inequalities in order not to reproduce them. Examples for implementing this understanding of informed consent in research processes are the usage of flexible and repeatable formats of consent or establishing joint discussions about consent procedures as well as dissemination formats and contents.
