THE TREBLE DAMAGE CASE: FACT AND FICTION

I first want to give you some background regarding the statistics I will be discussing. About three years ago, various members of the Council of the Section of Antitrust Law began to express their concern that, although they as individual practitioners were frequently being called upon to testify or appear before various forums to discuss trends in treble-damage litigation, they often found that they had no data, either quantitative or qualitative, upon which they could rely as the basis of their opinion.
