This paper discusses some results of the research that was conducted about the conflict of jurisdiction between the ordinary criminal jurisdiction and indigenous criminal jurisdiction. It is highlighted that the legal uncertainty is presented for the indigenous community, due to lack of coordination of the processes between the two jurisdictions. From the study it became clear that the ordinary courts (traditional authorities) have global competition on all behaviors that are performed within the indigenous territory and therefore, they have sanctioning power and also the possibility of prosecution granted by the
