The article discusses problematic provisions of the Council of Europe Convention on the Prevention and Suppression of Violence against Women known as Instambul Convention of May 11, 2011. The author argues that the Instambul Convention defines the concept of gender as a social structure, and the limited interpretation given to it in the Explanatory Report to the Convention creates legal uncertainty about gender perception endangering the ratification of the Convention by the States. Moreover, by establishing gender identity and sexual orientation as a ground for non-discrimination for the first time at the level of such an international instrument, the Convention will, inter alia, facilitate the wider legislative recognition of social sex by more states. Also, the possibility of introduction educational programs, in national school curricula, on promoting gender neutrality and streriotype-free geneder roles demonstrates the potential for long-term strategies to implement the Convention even if in contradiction with the national legal concepts of marriage in some countries.
