Die Kinderrechte als Gegenstand elementarer Bedürfnisdiskurse - Parallelen, Desiderate und Kritik

In diesem Aufsatz werden die „Neuen Menschenrechte“ (NMR) von Martin mit den Kinderrechten konfrontiert. Die Autor*innen sehen diese Ausarbeitung als logische Konsequenz im Diskurs um die Anknupfungspunkte der NMR in diesem Buch. Es findet eine Analyse von Parallelen und Inhalten beider Ansatze statt und der ethische und grundlegende Duktus beider Elemente wird skizziert. Anschliesend werden mithilfe einer Gegenuberstellung die Limitationen der NMR unter dem Aspekt der Bedurfnisse von Kindern aufgezeigt. Insbesondere wird hier der Fokus auf Teilhabegerechtigkeit und die damit verbundenen Limitationen und Potenziale gesetzt. In this paper, Martin's New Human Rights (NMR) approach is confronted with the rights of the child. The authors see this elaboration as a logical consequence in the discourse about the starting points of the NMR in this book. There is an analysis of parallels and contents of both approaches and the ethical and fundamental characteristics of both elements are outlined. Subsequently, the limitations of the NMR are presented by comparison under the aspect of the needs of children. In particular, the focus is placed on the justice of participation and the limitations and potentials associated with it.
