ANTI COMPETITIVE AGREEMENTS IN THE INDIAN CIVIL AVIATION SECTOR- A NEED FOR REFORMS

The Primary legislation in India dealing with the operations of a civilian airport is The Airport Authority of India Act, 1994[1]. The Competition Act [The Act] 2002[2] on the other hand is the regulatory legislation which acts as the vigilante of anti- competitive practices amongst enterprises as defined by the Competition Act. However, the jurisprudence on civil aviation and its impact on competition has not been studied in detail as compared to the Telecommunications Sector- Competition Act, or the E-commerce – Competition Act perspective. Therefore, the researcher through the medium of this research paper has established a link between the civil aviation sector vis-a-vis the Competition Act.
