Causes for the abnormal termination of the process after the call for tenders in Valle del Cauca (2013-2016)

The life cycle of a construction project involves planning activities, supervision during the execution and termination or closure of the contractual activity. The public administration holds contracts to respond to works, goods or services required by the communities and therefore should follow the aforementioned cycle. However, sometimes the abnormal termination of a process is declared after it is convened, which generates a break in the proper execution of the object that motivated said process. In this study, we reviewed the causes that led to the abrupt termination after the convocation of counter-tendential processes under the public bidding modality in Valle del Cauca between 2013 and 2016. It found was that the greatest deficiencies occur due to inadequate formulation of the bidding documents and breach thereof once the contract awarded has been and due to lack of legal requirements such as the RUP (registration of one of the proponents) among others, and the modification of the schedule and the budget once the tender awarded has been. Finally, it concluded is that it is necessary for government entities planning effectively the preparatory stage of the proposals before making the call for a process in any of the contracting modalities so that the proponents can verify compliance with both the requirements enabling as scoring. For this, it suggested is to improve the existing digital platform for the registration of counter-current initiatives.
