Gobernanza policéntrica para la resiliencia al cambio climático: análisis legislativo comparado y Ley Marco de Cambio en Chile

A governance arrangement capable of providing effective, proactive, and adaptive responses to climate change should address at least three challenges: (1) it should pay attention to the particularities of local contexts without losing sight of global interdependencies; (2) it should coherently coordinate a multiplicity of perspectives and autonomous actors; and (3) it should encourage innovation and learning while maintaining a minimum degree of stability, necessary for making predictions and decisions. The article argues that a polycentric governance approach, especially in its system-theoretical interpretation, offers effective responses to these three challenges. Then, it adopts this approach to evaluate current climate change regulations, offering a comparative analysis of international legislation, and a case study of Chile’s Draft Framework Law on Climate Change. The paper concludes by identifying opportunities and challenges and proposing public policy recommendations.
