Degressieve Opbouw in Uitkeringsovereenkomst Wel Degelijk Mogelijk Met Behoud Verplichtstelling (Decreasing Accrual in Defined Benefit Agreements is Possible While Maintaining Mandatory Participation)

Dutch Abstract: Enkele juristen beweren dat degressieve opbouw in een uitkeringsovereenkomst (hierna: DOU) in strijd is met EU-recht. Zij stellen dat DOU strijd oplevert met de richtlijn gelijke behandeling 2000/78. Een rechtvaardigingsgrond is er niet. In dit WP ga ik hier nader op in.English Abstract: Some lawyers argue that decreasing accrual is contrary to EU law. They argue that this accrual is contrary to 2000/78. There is no justification.
