The present invention provides a method for negotiating terminal capability and the method includes the following steps: in a process that a terminal performs an uncontrolled handover between world interoperability for microwave access (WiMAX) base stations (BSs), a source service BS transmits a context response message to a target BS, and said context response message carries capability parameters that said source service BS negotiates with said terminal and the own capability parameters of said terminal; after receiving said context response message, said target BS performs the capability negotiation according to said own capability parameters of said terminal in the context response message and the capability parameters of the present target BS, and notifies new capability parameters information acquired through the negotiation to said terminal, thus avoiding the terminal capability being narrowed down after the uncontrolled handover. The present invention also provides a system and a WiMAX BS supporting terminal capability negotiation. The present invention prevents the risk that the terminal capability is narrowed down after the uncontrolled handover.
