The present work is a collection of legal rules and a comparative study of the conduct of civil proceedings for environmental harm and indigenous justice from ancient practices in the High Nangaritza Shuar communities . As is generally known, the new Constitution of the Republic incorporated some major issues in his new text, among them are the recognition of nature as a subject of rights , as well as recognition of indigenous justice as such. Topics that have led to new research, studies , analysis. As regards this work has been carried out a comparative study of the conduct of civil and indigenous justice in the areas of environmental damage , which allowed us to conclude that we can not speak of complete compatibility between justice ordinary and indigenous justice , because in some cases it is an offense for environmental damage, in the Shuar communities is a way of life based on ancient culture , as exemplified by hunting, or logging. Throughout the paper we establish the main legal provisions of environmental law , as well as an analysis of environmental problems and the use of indigenous justice from ancient practices in the High Nangaritza Shuar communities leads us to determine the compatibility of the ordinary justice and indigenous justice in the environmental field .
