Gestación por sustitución y derecho a prestaciones de Seguridad Social. Razones para una regulación urgente

espanolEl objeto de este estudio es denunciar la situacion actual existente en torno a la maternidad subrogada y abogar por una reforma urgente sobre la misma. Los diversos criterios interpretativos mantenidos en sede administrativa y judicial y, dentro de esta ultima, entre los tribunales civiles y los del orden social, estan generando una gran inseguridad juridica. La doctrina del TS reconociendo el derecho a prestaciones de maternidad y paternidad en estos supuestos (tanto para el personal laboral como para el estatutario y autonomos) ha llevado al INSS a reconocer la gestacion por sustitucion como situacion protegida a efectos de tales prestaciones, obligando a dictar los criterios interpretativos pertinentes. Pero la regulacion de estas cuestiones no puede descansar "sine die" sobre los criterios jurisprudenciales y administrativos dictados hasta la fecha para casos concretos. La intervencion del legislador debe poner fin a las situaciones discriminatorias a las que la aplicacion de la doctrina jurisprudencial esta dando lugar. EnglishThe purpose of this study is to denounce the current situation regarding surrogate motherhood and to advocate an urgent reform of it. The various interpretative criteria maintained in administrative and judicial headquarters and between the civil courts and those of the social order, are generating a great legal insecurity. The Supreme Court doctrine recognizing the right to maternity and paternity benefits in these cases (both for the workforce and for the statutory and autonomous staff) has led the Social Security to recognize gestation by substitution as a protected situation for the purposes of such benefits, dictate the relevant interpretative criteria. But the regulation of these issues can not rest indefinitely on the jurisprudential and administrative criteria dictated to date for specific cases. The intervention of the legislator must put an end to the discriminatory situations to which the application of jurisprudential doctrine is giving rise.
