: Texas courts have held that if a doctor has been properly warned of the possible side effects of a medication, he or she is obligated to warn the patient of those effects. Drug-related injuries probably account for 10% of all malpractice claims. This article discusses the standard of care in a lawsuit based on an adverse drug reaction, describes a number of specific examples, and suggests 10 steps to help avoid becoming a defendant in an adverse drug-reaction lawsuit.
