In the case of Kotku Bread Pty Ltd v Vero Insurance Limited [2012] QSC 109, an issue arose as to whether an insured had complied with its duty of disclosure in accordance with s 21(1) of the Insurance Contracts Act 1984 (the ICA) and, whether the insured could rely on s 21(2)(c) of the ICA, which provides that an insured is not required to disclose matters in respect of which the insurer has knowledge.
