“Mental capacity” is a term that generally refers to a person’s decision-making skills. This edited collection explores the law in New Zealand in relation to making decisions about “civil” (or noncriminal) matters such as personal care and welfare, managing property and making a will. It explores how mental capacity should be assessed, by whom, and the consequences of a finding that someone is deemed to lack the ability to make decisions on his or her own.
