Let me open by reminding you of a few of the facts of our first hypothetical:* Superior, a United States electronic motor controls manufacturer with about eighteen percent of the United States market if the United States market is the relevant geographic market, and if all electronic motor controls is a relevant product market and GDC, a West German firm also engaged in the manufacture and sale of electronic motor controls, want to enter into some interesting arrangements. Whether these types of arrangements are joint ventures or not I guess depends on whether or not you buy Rick Rule's "spectrum" analysis1 to the effect that anything that contains an agreement is a joint venture.
