Information causes confusion

The new right to information, introduced into French law by the implementation of the IP Enforcement Directive (Directive 2004/48), has given rise to conflicting case law on whether such relief can be sought in the course of infringement proceedings or once the infringement has been acknowledged by a judgment on the merits.
