Cuestiones controvertidas en la jurisprudencia menor derivadas de la utilización de elementos automáticos en materia de sanciones de tráfico

This article proposes a critical analysis of the different judicial criteria in the application of sanctions and procedures decided by the traffic administration involving technological or automatic elements for the detection and repression of offences. It analyses the requirements and guarantees in the use of these methods and its implementation through the administrative trafficking procedure itself and the different technical standards established. Finally, it tackles the enforceability of the controls and technical tests that ensure the proper functioning of the controls and the consequences of their omission.
