ANALISIS PELAKSANAAN ITSBAT NIKAH TERHADAP PERNIKAHAN SIRRI DI PENGADILAN AGAMA BANTAENG

Abstrak Pokok permasalahan penelitian ini adalah Analisis Pelaksanaan Itsbat Nikah Terhadap Pernikahan Sirri di Pengadilan Agama Bantaeng. Adapun sub masalah yakni: 1) Bagaimana pelaksanaan persidangan itsbat nikah terhadap pernikahan sirri di Pengadilan Agama Bantaeng? 2) Bagaimana pertimbangan hakim dalam menyelesaikan perkara itsbat nikah? Hasil dari penelitian ini menunjukkan bahwa Permohonan itsbat nikah di Pengadilan Agama Bantaeng yang ditetapkan/dikabulkan adalah pernikahan yang memenuhi syarat dan rukun pernikahan, dan sesuai dengan ketentuan tertentu yang berhak untuk mengajukan itsbat nikah yang dijelaskan dalam Kompilasi Hukum Islam Pasal 7 ayat (3). Kemudian prosedurnya sudah sesuai berdasarkan buku Pedoman Pelaksanaan Tugas dan Administrasi Peradilan Agama Buku II serta Peraturan lainnya. Namun yang menjadi faktor tingginya permohonan itsbat nikah di Pengadilan Agama Bantaeng khususnya pada tahun 2019 sebesar 26,71% dengan jumlah 136 itsbat nikah yang telah diputuskan yaitu minimnya pemahaman masyarakat tentang pencatatan nikah, sehingga pernikahan sirri sering terjadi, dan beberapa faktor lainnya. Abstract The main problem of this research is the Analysis of the Implementation of Itsbat Marriage on Sirri's Marriage at the Bantaeng Religious Court. The sub-problems are: 1) How is the implementation of the marriage itsbat trial against sirri marriages at the Bantaeng Religious Court? 2) How is the judge's consideration in resolving the marriage itsbat case? The results of this study indicate that the application for itsbat marriage at the Bantaeng Religious Court that is determined/accepted is a marriage that meets the requirements and pillars of marriage, and in accordance with certain provisions who are entitled to apply for a marriage certificate which is described in the Compilation of Islamic Law Article 7 paragraph (3). Then the procedure is in accordance with the Guidebook for the Implementation of Duties and Administration of Religious Courts Book II and other regulations. However, what is a factor in the high application for marriage itsbat at the Bantaeng Religious Court, especially in 2019, is 26.71% with a total of 136 marriage certificates that have been decided, namely the lack of public understanding about marriage registration, so that sirri marriages often occur, and several other factors.
