건축규제에 대한 민원 분석에 관한 연구

Building Regulations, widely applied in building design, building permit, construction, etc, is a crucial part of building activities and closely linked to building administration. Despite growing public demands and expectations for building Regulations, complaints and dissatisfaction felt by people have been considerably increased. Therefore, this research aimed to identify types of civil appeals and suggest the primary direction for improving building regulations through analysis of civil appeals. As the results of the analysis, there were several notable findings. A considerable number of civil appeals was linked to not only Building Act but also various related statutes such as National Land Planning and Utilization Act, which meant consideration of overall regulation of related statutes was necessary. Also, many civil appeals were occurred by unauthorized regulation of local government and problems of delegation in the system since most of improved civil appeals were related to local laws and regulations. Finally, a lack of clarity in the statute was a reason that occurred civil appeals and distrust of government. Based on these findings, suggestions to reduce civil appeals were drawn as follows: provision of standard ordinance, establishment of regulatory information system, establishment of monitoring and management system. The research would contribute to highlighting credibility of building administration and reducing social costs caused by unnecessary regulations and inefficient administration processes.
