DESAFÍOS PARA LAS INSTITUCIONES DE EDUCACIÓN SUPERIOR EN EL TRÁNSITO A LA JUSTICIA PENAL ORAL EN MÉXICO

Posterior a las reformas y adiciones constitucionales en materia de justicia penal y de seguridad publica que en 2008 experimento el sistema juridico mexicano, ha gestado un proceso incesante e inacabado para su implementacion, involucrando a todos los operadores del sistema; sin embargo, en este proceso de armonizacion e implementacion los esfuerzos se tornan asimetricos en las Instituciones de Educacion Superior, inmersos en sus propios formalismos de diseno y actualizacion curricular, actualizacion docente y limitaciones presupuestarias. El presente analisis plantea como objetivo contextualizar los desafios para las Universidades en la formacion del abogado frente a la implementacion del sistema penal acusatorio; metodologicamente se soporta en un analisis exploratorio de las construcciones curriculares en materia penal en el noroeste de Mexico. Abstract: Following constitutional reforms and additions in criminal justice and public safety in 2008 experienced the Mexican legal system, it favoring an incessant and unfinished process for implementation, involving all system operators; however, in this process of harmonization and implementation the efforts become asymmetric in Institutions of Higher Education, immersed in their own design formalisms and curricular renovation, teacher updating and budgetary constraints. This analysis proposes as a main aim contextualize the challenges for Universities in the formation of a lawyer facing the implementation of the adversarial criminal justice system; methodologically is supported on an exploratory analysis of the curricular constructions in criminal matters in Mexico northwest.
