COLOMBIA: LAS OMISIONES INCONSTITUCIONALES DEL LEGISLADOR Y EL DEBER ESTATAL DE GARANTIZAR DERECHOS

Este texto se propone exponer el desarrollo del segundo objetivo especifico del proyecto de investigacion denominado “La justicia constitucional y las omisiones legislativas en Colombia frente al panorama internacional”, el cual busca explicar la aplicacion de la omision legislativa inconstitucional desde la perspectiva de la obligacion del Estado de proteger derechos civiles, politicos, economicos, sociales y culturales. El autor concluye que en materia de omision legislativa inconstitucional, la Corte Constitucional tiene la facultad y el deber de subsanar las normas emitidas de manera insuficiente por el legislador, a traves de una sentencia integradora o de exequibilidad  condicionada para extender los efectos juridicos de dicha norma a los sujetos excluidos injustificadamente; siempre que con esa omision se vulneren derechos civiles y politicos directamente, o se violen derechos economicos, sociales y culturales vinculados intimamente a un derecho fundamental. ABSTRACT This text  aims  to  expose  the  development  of  the  second  specific  objective  of the  re- search  called “Constitutional  justice  and legislative   omissions  in Colombia in front  of  the international  scene”,   which  pretends  to  explain  the  application of  the  un constitutional legislative  omission  from  the   perspective  of  the   obligation  of   the  State  to  protect  civil, political,   economic,  social  and  cultural  rights.  The  autor  concludes   that   in matters  of un constitutional  legislative  omission,  the  Constitutional  Court   has  the  faculty and  the duty  to  correct  the  norms  issued  insufficiently  by  the  legislator,  through  an  integrating  or  conditional  constitutionality  sentence  to   extend  the  legal  effects  of  the norm   to the  excluded  subjects; it  could  happen  when  the  omission  directly  violates  civil and political rights, or violates economic, social and cultural rights intimately linked to a fundamental  right.
