The Unchangeablity of Burden of Proof

The problem about burden of proof plays an important role in the study of the theory of civil procedure.This paper differentiates and analyses the popular theory about the tranaform of burden of proof in China,pointing out that this kind of theory confuses the original meaning and legal nature of burden of proof.It is necessary to clear up ambiguity from theory of law.Moreover,this paper expounds the certainty of burden of proof through discussing the essence of burden of proof.In a word,burden of proof in a civil case is decided by the nature of the case.In the course of the dispute,burden of proof is stable and unchangeable.
