AS GARANTIAS CONSTITUCIONAIS DA PRIVACIDADE E LIBERDADE DE EXPRESSÃO NO MARCO CIVIL DA INTERNET

O presente trabalho vem discutir o uso das garantias constitucionais da privacidade e liberdade de expressao em face da vigencia da Lei no 12.965/14, a Lei do Marco Civil da Internet. O objetivo geral da pesquisa e investigar sobre, quais as garantias constitucionais devem prevalecer dentro das relacoes pessoais praticadas na Internet. Sao objetivos especificos: definir as garantias constitucionais da liberdade de expressao e da privacidade; discutir a regulamentacao e a importância de uma legislacao que discorra sobre o uso da internet dentro do territorio nacional, e avaliar as situacoes e o uso das garantias constitucionais da liberdade de expressao e da privacidade com o advento da Lei no 12.965/2014. Conclui-se que se faz necessario o julgador aplicar o melhor principio que atenda os interesses da sociedade sem prejudicar a Estado Democratico de Direito, ou seja, nao se pode restringir a liberdade das pessoas. Abstract : This work is to discuss the use of constitutional guarantees of privacy and freedom of expression in the face of the enactment of Law No. 12,965 / 14, Law of Civil Marco Internet. The overall objective of the research is to investigate on what constitutional guarantees should prevail within personal relationships practiced on the Internet. Specific objectives: define the constitutional guarantees of freedom of expression and privacy; discuss the regulation and the importance of legislation discorra on the use of internet within the national territory, and assess situations and the use of constitutional guarantees of freedom of expression and privacy with the enactment of Law 12,965 / 2014. It follows that if the judge is necessary to apply the principle that best meets the interests of society without harming the democratic rule of law, that is, it can not restrict the freedom of people.
