《劳动合同法》将集体合同规定为特别劳动合同,忽视了集体合同与劳动合同之间的根本性差异,因而遭遇到法理障碍和制度困境。集体合同在主体、效力和争议处理机制等方面均具有自身的制度特性,应当在未来立法中纳入集体劳动关系立法框架中,与工会组织、集体协商、集体争议处理衔接配合,形成完善的集体劳动法律体系。
