La prisión preventiva en América Latina en tiempos de reformas y contrarreformas del proceso penal

Con razon se afirma que esta fue la causa principal de la reforma procesal penal, que se inicio a principios de los noventa, cuando el hacinamiento carcelario habia llegado a limites insostenibles. El proceso de la reforma y su relacion con la violencia y la seguridad ciudadana, se abordan en el articulo, junto a un detallado estudio de la prision preventiva, sus requisitos y una actualizacion de las cifras de la mayoria de los paises de la region, hasta los ultimos anos, incluido el 2020, en relacion con varios paises, considerando los avances y retrocesos, que se han experimentado con posterioridad a la aprobacion de las nuevas leyes procesales penales EnglishOne of the problems that most worries the international community and the different agencies of the United Nations, since the last decades of the last century and the first decades of the 21st century, are the high numbers of prisoners without conviction in Latin America. It is rightly stated that this was the main cause of the criminal procedure reforms, which began in the early 1990s, when prison overcrowding had reached unsustainable limits. The reform process and its relationship with violence and citizen security are addressed in the article, together with a detailed study of pretrial detention, its requirements and an update of the figures for most countries in the region.
