This is an interdisciplinary chapter that identifies the existence of a non-legal IP system at work in the context of conceptual art practices. This piece focuses on the law of the UK and US and features an interview with a representative of the estate of the late Sol LeWitt, a US artist who was one of the architects of the conceptual art movement. It seeks to argue that current copyright law in both the UK and US struggles to protect visual translations of artistic works communicated by means of instructions in literary form and also with art works whose notation may be seen as conceptually distinct from their final form. It is hoped that this piece will be seen as an original and significant development of knowledge in terms of the understanding of how the legal and artistic worlds interface with each other and how social norms effectively support such non-legal IP systems in the art world. it is intended to be of relevance to both communities.
