The objective of this study is to approach poverty as a deprivation of the capacities (capabilites) in Amartya Sen and to base the necessary action of the State through public policies to guarantee basic social rights in facing periods of severe crisis. In dark times, like the Pandemic Health - Covid-19, the essentiality and responsibility of the State in view of the common good (art. 1, III) and the insufficiency of the so-called minimum state are demonstrated. CF 88, founded on social rights, summarizes this prerogative. Integrated assistance policies demand coordinated and collective action, whether from public entities or social institutions. The denial of basic rights creates exclusions and impedes people's elementary development. This study, whose approach methodology is deductive, aims to address poverty as a deprivation of capacities (capabilites) in Amartya Sen and to base the necessary action of the State through public policies to guarantee basic social rights in facing periods of severe crisis.
