THE ROLE OF THE COURTS IN APPLYING ECONOMICS

Contrary to popular belief, being on the D.C. Circuit has advantages, as well as penalties. As an example of one or the other I won't say which I haven't seen an antitrust case since I got there. Now, the absence of antitrust cases may be peculiar to our circuit, or it may lend some credibility to the rumor that antitrust policy is dead, probably as a result of foul play, and that the carcass is buried. As to the truth ofthat rumor, I cannot testify, but it's very pleasant, I can tell you, to share once more a platform with some of the usual suspects.
