Fundamentos epistemológicos del neoconstitucionalismo Latinoamericano. Aciertos y desaciertos en su regulación jurídica y aplicación práctica en Ecuador

The work aims to systematize the referential theoretical framework on the subject of the application of principles and values ​​in structural changes in the conception of the State, starting from the doctrinal, normative and jurisprudential study in national and international law, in order to contribute to the correct legal and practical application of neoconstitutionalism. In this way, it is evaluated that the contributions may be aimed at carrying out a conceptual and historical analysis of the new philosophical law of justice and being able to establish a criterion on the work of the judge and on his successes or mistakes in the administration of justice in Ecuador. On the other hand, it is of great importance to identify the constitutionality block as a basis for the effectiveness of human rights, in domestic and international law. This study will provide scientific research, with solid legal and philosophical bases, on the correct implementation of the neo-constitutional system in Ecuador and the scope of the decisions of international courts in domestic law. The methods used from the theoretical level were the logical historical and the synthetic analytical and from the empyrean the document analysis.
